These Terms of Service ("Terms") are an agreement between you and Data Solutions Enterprises ("Data Solutions Enterprises," "we," "us," or "our") governing your access to and use of the website datasolutionsenterprises.com (the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. The Site and what these Terms cover
The Site provides information about Data Solutions Enterprises, our healthcare data and AI services, and our SecuraSail compliance platform. These Terms cover the Site only. Use of the SecuraSail platform itself (app.securasail.com) requires an account and is governed by the subscription agreement and terms presented in the platform or signed with us; if those terms conflict with these, the platform or signed terms control for your use of the platform.
2. Eligibility
The Site is intended for business audiences. You must be at least 16 years old to use the Site. By using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Acceptable use
You agree that you will not:
- Use the Site in violation of any applicable law or regulation;
- Attempt to gain unauthorized access to the Site, its hosting environment, or any related systems or accounts;
- Probe, scan, or test the Site for vulnerabilities, or breach or circumvent any security or authentication measure, without our prior written permission;
- Interfere with or disrupt the Site, including by transmitting malware, launching denial-of-service attacks, or imposing an unreasonable load on our infrastructure;
- Scrape, harvest, or collect information from the Site by automated means in a manner that burdens the Site or violates these Terms;
- Use the contact form to send spam, unlawful content, or — as explained in our Privacy Policy — protected health information or other regulated sensitive data;
- Misrepresent your identity or affiliation, or use the Site's content to mislead others.
4. Intellectual property
The Site and its content — including text, graphics, logos, images, page designs, and their arrangement — are owned by Data Solutions Enterprises or our licensors and are protected by copyright, trademark, and other laws. "Data Solutions Enterprises" and "SecuraSail" and the associated logos are our marks. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your internal business and informational purposes. No other rights are granted. You may not use our marks, or content from the Site, in a way that implies our endorsement, sponsorship, or affiliation without our prior written consent.
5. Feedback
If you send us suggestions, ideas, or feedback about the Site or our products, you agree we may use them without restriction or obligation to you. We will not use feedback in a way that identifies you without your consent.

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ITS CONTENT IS COMPLETE, ACCURATE, OR CURRENT. THIS SECTION DOES NOT LIMIT WARRANTIES OR COMMITMENTS WE EXPRESSLY MAKE IN A SIGNED CUSTOMER AGREEMENT, AND DOES NOT EXCLUDE WARRANTIES THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATA SOLUTIONS ENTERPRISES AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE SAME EXTENT, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). THESE LIMITS APPLY TO THE SITE ONLY; LIABILITY UNDER A SIGNED CUSTOMER AGREEMENT IS GOVERNED BY THAT AGREEMENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
10. Indemnification
You agree to defend, indemnify, and hold harmless Data Solutions Enterprises from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Site.
11. Changes to the Site and to these Terms
We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time; the revised version will be posted on this page, and material changes will be highlighted here. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
12. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law. Sections that by their nature should survive termination (including Sections 4, 5, 8, 9, 10, and 13) survive.
13. Governing law and disputes
These Terms and any dispute arising out of or relating to the Site are governed by the laws of the State of Texas and applicable United States federal law, without regard to conflict-of-laws principles. The exclusive venue for any such dispute is the state or federal courts located in Harris County, Texas, and each party consents to personal jurisdiction there. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction.
14. General
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site and supersede any prior understandings on that subject. If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
